Terms of Service

Please read these terms carefully before using BuzzBit X.

1. Description of Service

BuzzBit X ("the Platform") is a multi-tenant SaaS platform operated by BuzzBit X Ltd. ("Company", "we", "us", or "our") that provides e-commerce marketing automation tools. The Platform enables businesses to manage, automate, and optimize their marketing operations across multiple channels including email, WhatsApp, social media (TikTok, Instagram, Facebook), and on-site popups.

Our services include but are not limited to:

• Multi-channel campaign management (email, WhatsApp, social media)
• Direct publishing of merchant-supplied content to connected accounts (including TikTok Direct Post)
• AI-powered content generation and optimization
• Customer segmentation and audience targeting
• Marketing analytics and performance reporting
• E-commerce platform integrations (Shopify, WooCommerce, etc.)
• Automated workflow builders and decision trees
• A/B testing and conversion optimization
• Customer relationship management (CRM) tools

2. Eligibility

By accessing or using BuzzBit X, you represent and warrant that:

• You are at least 18 years of age or the legal age of majority in your jurisdiction.
• You have the legal authority to enter into these Terms on behalf of yourself or the entity you represent.
• You are not located in a country subject to a U.S. Government embargo or sanctioned by the EU.
• You have not been previously suspended or removed from the Platform.
• Your use of the Platform will comply with all applicable local, state, national, and international laws.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. In such cases, "you" refers to that entity.

3. Account Registration & Security

3.1 Registration Requirements

To use the Platform, you must create an account by providing accurate, complete, and current information including your full name, valid email address, and a strong password. You agree to update your information promptly if it changes.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Use a strong, unique password of at least 8 characters.
• Enable two-factor authentication (2FA) when available.
• Not share your login credentials with unauthorized individuals.
• Notify us immediately at security@buzzbitx.com if you suspect unauthorized access.

3.3 Workspace Management

Each account operates within one or more workspaces. As a workspace administrator, you are responsible for managing team member access, roles, and permissions. You must ensure that all users within your workspace comply with these Terms.

4. Acceptable Use Policy

You agree not to use BuzzBit X to:

• Send unsolicited bulk messages (spam) or purchase contact lists.
• Distribute malware, viruses, or other harmful code.
• Engage in phishing, fraud, or deceptive practices.
• Promote illegal goods or services including counterfeit products.
• Harass, threaten, or defame any individual or organization.
• Violate any applicable anti-spam laws (CAN-SPAM, GDPR, CASL, etc.).
• Infringe on the intellectual property rights of others.
• Attempt to reverse-engineer, decompile, or exploit the Platform.
• Circumvent any security measures, rate limits, or access controls.

5. Connected Social Platforms (including TikTok)

BuzzBit X integrates with third-party social platforms including TikTok, Instagram, Facebook, and WhatsApp. When you connect any such platform, the following applies:

• You are the creator. Every post, video, photo, or message published through BuzzBit X to a connected platform is originated, composed, and approved by you (the merchant).
• You retain ownership. BuzzBit X claims no ownership of any content you publish through the Platform.
• You comply with their rules. Your use of each connected platform is also governed by that platform's terms and community guidelines. Specifically, content published to TikTok via BuzzBit X is subject to TikTok's Terms of Service, Community Guidelines, Music Usage Confirmation, and (where applicable) Branded Content Policy.
• Content is unmodified. BuzzBit X does not add watermarks, overlays, or branding to your media before it is uploaded to TikTok or any other connected platform. The bytes the platform receives are byte-identical to what you uploaded.
• Authentic content only. You agree not to use BuzzBit X to publish scraped, AI-impersonated, or otherwise inauthentic content to any connected social platform.

6. AI & Data Processing

6.1 AI-Powered Features

BuzzBit X uses artificial intelligence and machine learning to power features such as content generation, audience segmentation, send-time optimization, and predictive analytics. AI-generated content is provided as suggestions and should be reviewed by you before publishing.

6.2 Data Usage for AI

By default, your workspace data is not used to train our AI models. We use anonymized, aggregated data to improve our services. You may opt in to contribute anonymized data to model improvement through your workspace settings.

6.3 AI Limitations

While we strive for accuracy, AI-generated outputs may contain errors, biases, or inaccuracies. You are solely responsible for reviewing, editing, and approving all AI-generated content before it is sent to your customers or published to any social platform. BuzzBit X is not liable for any consequences arising from AI-generated content that you approve and publish.

7. Subscription Plans & Billing

7.1 Free Trial

New accounts are eligible for a 14-day free trial with access to all features. No credit card is required to start a trial. At the end of the trial, your account will be downgraded to the Free tier unless you subscribe to a paid plan.

7.2 Paid Plans

Paid subscriptions are billed monthly or annually in advance. All fees are quoted in US Dollars (USD) unless otherwise specified. Prices are exclusive of applicable taxes, which will be added at checkout based on your jurisdiction.

7.3 Payment Methods

We accept major credit cards (Visa, Mastercard, American Express) and other payment methods as displayed at checkout. You authorize us to charge your selected payment method on a recurring basis.

7.4 Refund Policy

Annual subscriptions may be refunded within 14 days of initial purchase if you are not satisfied. Monthly subscriptions are non-refundable but you may cancel at any time to prevent future charges. Refund requests should be sent to billing@buzzbitx.com.

7.5 Overages

If your usage exceeds the limits of your plan (e.g., message volume, contact count, API calls), you will be notified and may incur overage charges at the rates specified in your plan details. We will provide at least 7 days notice before charging overages.

8. Intellectual Property Rights

8.1 Our Intellectual Property

The Platform, including all software, designs, text, graphics, logos, and trademarks, is the exclusive property of BuzzBit X Ltd. and its licensors. These Terms do not grant you any right, title, or interest in our intellectual property except the limited license to use the Platform as described herein.

8.2 Your Content

You retain all ownership rights to the content you upload, create, or transmit through the Platform ("Your Content"). By using the Platform, you grant us a limited, non-exclusive, worldwide license to process, store, and transmit Your Content solely for the purpose of providing the services.

8.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Platform, you grant us an unrestricted, irrevocable, perpetual license to use and incorporate such feedback into our products without any obligation or compensation to you.

You agree to indemnify, defend, and hold harmless BuzzBit X Ltd., its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Platform or violation of these Terms.
• Your Content or marketing campaigns sent or published through the Platform (including content posted to TikTok or any other connected social platform).
• Your violation of any applicable law or regulation.
• Your infringement of any third-party intellectual property or privacy rights.
• Any dispute between you and your customers arising from messages sent via the Platform.

12. Termination

12.1 Termination by You

You may terminate your account at any time by navigating to your workspace settings and selecting "Delete Account", or by contacting us at support@buzzbitx.com. Termination will take effect at the end of your current billing period.

12.2 Termination by Us

We may suspend or terminate your account immediately if you violate these Terms, the Acceptable Use Policy, or any applicable law. We may also terminate accounts that remain inactive for more than 12 consecutive months.

12.3 Effect of Termination

Upon termination, your right to access the Platform ceases immediately. We will retain your data for 30 days following termination, during which you may request an export of your data. After 30 days, your data will be permanently deleted in accordance with our Privacy Policy. Any OAuth tokens we hold for your connected platforms (including TikTok) are revoked at the platform and removed locally on disconnect.

13. Data Protection

We take data protection seriously and comply with applicable data protection laws including GDPR, CCPA, and POPIA. Key commitments:

• Data Processing: We process your data solely to provide and improve the Platform.
• Data Location: Data is stored on servers located in the United States and European Union.
• Sub-processors: We maintain a list of sub-processors and will notify you of any changes.
• Data Portability: You may request an export of your data at any time in machine-readable format.
• Breach Notification: In the event of a data breach, we will notify affected users within 72 hours.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Post the updated Terms on this page with a new "Last Updated" date.
• Send you an email notification at least 30 days before the changes take effect.
• Display a prominent notice within the Platform.

Your continued use of the Platform after the effective date of modified Terms constitutes your acceptance of the changes. If you do not agree with the modifications, you must stop using the Platform and terminate your account before the changes take effect.

15. General Provisions

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

15.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.4 Entire Agreement

These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and BuzzBit X Ltd. regarding the Platform and supersede all prior agreements and understandings.

15.5 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.

15.6 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it at a later time.

16. Third-Party Integrations via MCP & OAuth

BuzzBit X exposes a Model Context Protocol (MCP) server at https://api.buzzbitx.com/mcp and supports OAuth 2.0 authentication, including listing on the Anthropic Connectors Marketplace. The following terms govern your use of these integrations:

16.1 Responsibility Split

• You (the merchant) are responsible for choosing which third-party clients (e.g., Claude Desktop, Claude.ai, custom MCP clients) to authorize, granting consent on the BuzzBit X consent screen, and reviewing the scopes you approve. You may revoke any granted access at any time from your workspace settings.
• BuzzBit X is responsible for: enforcing the scopes you approved, isolating your workspace data from any other workspace, encrypting tokens at rest (AES-256-GCM), logging all MCP tool invocations for audit, and honoring revocation requests within seconds.
• The third-party client (e.g., Anthropic Claude) is responsible for handling the data it receives in accordance with its own Terms of Service and Privacy Policy. BuzzBit X is not liable for any client-side handling of data once it has been returned to a properly authenticated request.

16.2 Liability Scope

The disclaimers and limitation of liability in Sections 9 and 10 apply in full to data accessed, returned, or modified via the MCP server or OAuth flow. In particular, BuzzBit X is not liable for: (a) actions taken by an AI agent using a token you authorized, (b) data exposure caused by your decision to share an access token with an untrusted party, or (c) any consequence of granting overly-broad scopes to a third-party client. You are solely responsible for reviewing and approving each scope before granting consent.

16.3 Disabling MCP & OAuth Access

You may disable MCP and OAuth integrations at any time:

• Revoke a specific client: Navigate to Settings → Integrations → Connected Apps and click "Revoke" next to the client you want to disconnect. The associated access and refresh tokens are revoked immediately and the client will need to re-authenticate to regain access.
• Disable all MCP/OAuth access for your workspace: Navigate to Settings → API → Disable MCP Server. This blocks all MCP and OAuth requests workspace-wide until re-enabled. Existing OAuth tokens are revoked at the time of disable.
• Email request: Email support@buzzbitx.com with the subject "Disable MCP/OAuth — [Workspace Name]" and we will process the request within one business day.
